INTRODUCTION AND GOVERNING LAW
These are the Terms & Conditions of Sale applicable to on-line purchases from Ute Store Australia (“Ute Store”). These conditions should also be read in conjunction with Ute Store’s General Website Terms and Conditions of use.
These terms and the laws of Queensland, Australia, apply to all transactions for the purchase of products (“Products”) from Ute Store through its web site at www.utestore.com and any associated web page (the “Site”). These terms represent the complete Agreement between Ute Store and the Buyer covering the sale of Products from this Site. Except for terms implied by applicable legislation, Ute Store does not offer or agree to any conditions, warranties, guarantees or representations relating to the quality, description or performance characteristics of the Products other than those set out in these terms. The Buyer’s completion of the Order form on this Site will constitute an offer to the Buyer to purchase Products (the “Order”). All Orders are subject to acceptance by Ute Store.
The prices to be paid by the Buyer for all Products will be Ute Store’s current selling price on the date of receipt by Ute Store of the Order, less any applicable discounts in effect at that time. All Orders will attract a delivery charge as set out on the Checkout.
Ute Store will not be responsible for errors in pricing that appear on the Site. Ute Store will notify a Buyer in the event of a pricing error on the Site before an Order is delivered. The Buyer will have the opportunity to cancel their Order within a reasonable time.
Ute Store reserves the right to change its prices from time to time without prior notice to the Buyer. All prices in this website include Australian Goods and Services Tax (GST) at 10%.
The GST payable by the Buyer will be shown on the invoice, which Ute Store will send to the Buyer. Delivery charges to the nominated address will be advised to the Buyer on the Checkout and Order confirmation pages of the Site.
If a standard order Product is “Unavailable to Ship” within 3 business days after Ute Store processes an Order, Ute Store will contact the Buyer to discuss delivery times or refund options. On custom and special order products, Ute Store will contact the Buyer should the expected delivery time exceed the time allotted for shipment of that product.
ORDER DELIVERY AND CANCELLATION
All Orders by the Buyer under this Agreement must be placed via the forms provided on this Site and must specify the information requested, including (but without limitation):
(a) Quantity and description of Products
(b) The full street address to which the Product is to be delivered
(c) Current billing address to which credit card statements are sent should a credit card be used for payment.
The Buyer must complete all information requested on the Order form before the Order is processed by Ute Store.
Ute Store will not accept orders:
(1) If the Buyer does not offer to pay by one of the payment methods listed in this website; or
(2) If the Buyer’s credit card provider does not confirm the payment.
Ute Store will send the Buyer an e-mail acknowledging the Products ordered as soon as possible after the Buyer places an Order. If Ute Store does not accept the Buyer’s Order for any reason, it will inform the Buyer by email in the same manner.
Shipment of a standard order Product will occur between 1-6 business days after acceptance of an Order. A Buyer can arrange collection of Orders from Ute Store either in-person or via alternative courier.
The Buyer acknowledges that Ute Store may, from time to time, be subject to production, delivery or other unforeseen delays and that Ute Store may allocate distribution of Products ordered among its customers at its sole discretion.

If no one is available at the delivery address to receive the Products, Ute Store’s delivery agent will leave an “unable to deliver” card at the address and the Buyer should follow the directions on that card to obtain delivery of the Products. Ute Store reserves the right to make partial delivery of an Order.
Payment for Products purchased from Ute Store via the Site can be made by VISA, MasterCard credit cards. We also accept Paypal, and Zip Pay / Zip Money and Direct Bank Deposits .
Ute Store will verify the credit card information submitted by the Buyer and will advise the Buyer that the Order has been accepted. The Buyer agrees to submit to Ute Store such information as may be reasonably requested by Ute Store for the authorisation and verification of its credit card purchases.
Ute Store reserves the right to exercise its lawful remedies if a dispute arises over payment through the Buyer’s credit card provider. In particular, but without limitation, if the Buyer’s credit card provider rejects a payment when due, Ute Store at its discretion may delay or cancel delivery of Orders placed by the Buyer.
Ute Store may also offset and deduct from any refund due to the Buyer all sums owed by the Buyer to Ute Store. If the Buyer’s account is placed in collection, Ute Store will be entitled to claim all reasonable expenses for collection, including legal fees incurred in connection therewith.
DEFECTIVE ITEMS AND WARRANTIES
All parts are covered only by manufacturer’s warranties and/or guarantees.
If an item arrives in not new condition as a result of a manufacturer defect, or a defect occurs during the intended use of the product, please contact us at firstname.lastname@example.org for further information.
Ute Store Australia does not reimburse for labour, incidental, or any other costs related to the installation of products under any circumstance.
Ute Store will arrange delivery of all Products to the Customer using its nominated freight carriers. A Buyer must not arrange its own courier to collect the Products from Ute Store.
INCORRECT SUPPLY OF ORDER
If due to a warehouse or other error on the part of Ute Store, the Buyer receives a Product which does not conform to its Order, the Buyer must contact Ute Store within 7 days of receipt of the Product and may purchase a replacement Product from the Site, after returning the original Product to Ute Store, provided that the returned Product is in new condition with its original packaging unopened.
All packages should be completely inspected at the time of delivery. Damaged packages should be refused. Please then call the freight company or Australia Post (whoever is responsible for the package) and report the damage. After contacting the carrier, please contact Ute Store Australia at email@example.com for further assistance with the damaged shipment, and to make arrangements for a replacement.
Ute Store accepts international orders from anywhere in the world.
International orders may be placed via our online shopping cart, by phone, or by fax.
All international orders are subject to additional shipping fees, and are not eligible for free shipping offers. To find out the shipping costs, please phone or email us with the exact items you wish to order, and the address to which they will be shipped.
For international orders placed online, a representative of Ute Store Australia will contact you with 1-2 working days to confirm your total price and shipping rates.
